Though, it was in August 2023, that Judge Roy Altman came up with a verdict in the case. There were certain facets of the original suit that he already ruled out, like the issues surrounding TVs and the internet wherein there will be no further claims. However, the rest of the trial will continue. In particular, the claims regarding the size of the Whopper advertised on the menus and the size of the Whopper in the restaurants will be accepted in the suit. And sure, the court is going to leave it up to a jury to determine whether the discrepancy between the promoted Whopper and the physical one is substantial enough to trick customers. So yes, as a result, the case will move ahead, and it will be up to a jury to find out if Burger King is guilty of any wrongdoing in the advertising campaign.
